1. Scope and Object of the General Conditions of the Store
These General Conditions are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Online Store Service Jovaty Furniture, based at Avenida de Campos Nº 362 Arm. 2 Vilela, under the unique registration and identification number of the legal person no. 515866504, with a share capital of €5.000, hereinafter referred to as "Jovaty Furniture".
1.1 Jovaty Furniture, "Seller", has products for sale on the website www.jovaty.com, and "ecommerce" services are available exclusively to customers/resellers.
1.2 The "Customers" indicate the entity or individual entrepreneur who acts/buys within the same business or profession. If you are not a "customer", we ask that you do not make purchases on the online sales website www.jovaty.com
1.3 Jovaty Furniture reserves the right not to process orders received from customers that are not "Customers" or those that do not comply with Jovaty Furniture's general sales conditions.
1.4 These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of orders placed on www.jovaty.com between customers of the Jovaty Furniture online store (www.jovaty.com) and the seller.
1.5 The "Customer" must provide the "Seller" with an email address, or the data relating to another form of contact, which are correct and complete and accepts that the "Seller" can contact him using these data, if he deems necessary.

2. Customer obligations

In case the customer violates any of these obligations, Jovaty Furniture reserves the right to eliminate future purchases, block access to the store, cancel the supply of any other services made available simultaneously by Jovaty Furniture to the same Customer; and, still, not allow the Customer's future access to any services made available by Jovaty Furniture.
3. How to order
3.1 To order on www.jovaty.com it is necessary that the customer has an e-mail account and that his browser is configured to accept cookies and pop-ups, in order to allow the enjoyment of all the browsability conditions of the Jovaty Furniture online store.
Placing an order on www.jovaty.com is easy:
1. Find the products you want to purchase;
2. Add the selected products to the Cart;
3. Finalize the purchase;
4. Review your order;
5. Confirm your order;
6. You will receive an order confirmation by email.
Your order is confirmed when you select the “Checkout” button at the end of the purchase process.
When Jovaty Furniture receives your order, a message will appear on the screen with your order number and all its details. The purchase agreement is finalized at that time.
An order confirmation is sent to your email. We suggest that you print it out or download this copy for future reference.
We reserve the right not to accept your order, or to cancel it even after automatic confirmation of your order.
By submitting the order form, you are accepting the general purchase conditions, as well as other conditions existing at www.jovaty.com, through links, including the general terms and conditions of use.
The seller may not process orders that do not have a sufficient guarantee of good collection; when orders are incomplete or incorrect, or the products ordered are no longer available. In the referred cases, we will inform you by e-mail that the sales contract has not been concluded and that the seller has not proceeded with the sale, specifying the reasons for this.
If the products presented in the online store (www.jovaty.com) are no longer available at the time of their last access or when the seller receives the order, the seller must inform about their unavailability within 30 days after receiving the order.
If an order has been placed and payment for products that are no longer available, the seller will refund the money paid for the unavailable items.
3.2 Right not to accept the order or cancel the purchase
Jovaty Furniture reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been accepted by us), (among others) in the following situations, exempt from liability for any damages or costs:
● The product is no longer available/in stock (payments will be returned);
● The billing information is not correct or verifiable;
● The order is signalled by our Security Systems as an incorrect order or an order susceptible to fraud;
● The transfer for payment of the order was not received by us within 30 days after processing the invoice;
● If we think you are under 16;
● It is not possible to deliver to the address provided.
3.3 Data verification
After receiving the order, we can perform some checks on it before preparing it.
These checks can include address verification, credibility and fraud verification. Regarding fraud verification, we perform partially automated checks on all orders to filter out unusual, suspicious or identified transactions that are susceptible to fraud. 6. Reservation of title

Please note that even though the website is updated with extreme care it is possible that the price information on the website contains errors. Jovaty Furniture does not commit to the offer and reserves the right to cancel your order, in the event of such an error occurring.
8. Quality and warranty
Jovaty Furniture does not sell second-hand products, defective or of inferior quality to the standards of those existing on the market. The main characteristics of each product shown on www.jovaty.com can be found on each product page.
Products offered for sale on www.jovaty.com may not exactly match the actual appearance in terms of image and colours, due to the Internet browser and monitor used.
If you decide to exercise the right to return products purchased, Jovaty Furniture has the right not to accept the return of products that have already been used or have been altered from their original or damaged condition.
9. Shipping and delivery
9.1 Delivery: where and when
We do not ship on certain holidays. We can only deliver an order if the shipping address is valid.
To receive the order, it is necessary to ensure that someone is at the address. This service does not include scheduling or appointment options, so the delivery of the order will be made without prior contact by the carrier. We do not guarantee this term in the periods of promotions, sales, Christmas and stock out.
9.2 Delivery Times
We deliver the products within 15 working days, unless out of stock. Jovaty Furniture will not be responsible for non-compliance, or delays in the fulfilment, of any obligation that is due to an event of force majeure, that is, an event, act or omission, beyond its reasonable control (Event of Force Majeure - which includes any event, act or omission outside the reasonable control of the "Seller").
We will try to deliver on time, to the extent commercially reasonable. As a rule, we always do this, however, we cannot guarantee timely delivery.
9.3 Partial deliveries
Whenever possible we will try to deliver everything in just one shipment. However, we reserve the right to split delivery of the order, for example (but not limited to) if part of the order is late or unavailable. In the event that we proceed with the division of the order, the customer will be notified, by email, of our intention to proceed in this way. For this purpose, the email address provided by the customer at the time of purchase will be used.
9.4 Inspection at the time of delivery
Upon delivery, the customer must inspect the packaging in order to ascertain any damage. If the customer finds that the products are damaged, he must not accept delivery of the order, which will be returned. Jovaty Furniture will refund the amounts paid for the order or exchange the item as soon as the warehouse receives and completes the return process.
Any claim for non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. At the end of this period, Jovaty Furniture cannot be held responsible for its loss.
9.5 Survey in Warehouse
We also make it possible to pick up your order at our warehouse, which you can find when selecting the method of shipping your order (Pickup at Warehouse). After requesting the order, you will receive an email notification that guarantees the security of your order and will then allow you to collect your order in the warehouse. You will be notified of all the status of your order by email.
We are only responsible for withdrawals in storage that are requested directly on the site by the respective shipping method.
10. Shipping charges

10.2 Free shipping
We deliver throughout the country free of charge. If a customer places an order outside Portugal, it is subject to shipping fees, unless the value exceeds the minimum order value defined for your country or campaign, shipping will be done at no cost, that is, free of charge.
11. Privacy and Protection of Personal Data

11.2 The personal data identified on the order form as mandatory supply are indispensable for the provision of the Service by Jovaty Furniture. For this purpose, Jovaty Furniture cannot be held responsible for such access and/or use.
12.1 At the request of the Customer
The Customer may cancel his order by requesting it from Jovaty Furniture through the telephone number or e-mail referring the order number, which will be accepted as long as the order has not yet been processed. After processing, Jovaty Furniture will attempt to deliver it, but the Customer has the option of not accepting it.
For the purpose of cancellation, the Customer must indicate the following data to Jovaty Furniture:
a) Order number
b) TIN with which you placed the order and delivery address
12.2 By decision of Jovaty Furniture
Jovaty Furniture reserves the right not to process orders when it finds any inconsistency in the personal data presented or observes misconduct on the part of the buyer. Jovaty Furniture reserves the right not to process any order or refund, in the event of errors in the values and/or characteristics of the products, when these arise from technical problems or errors beyond Jovaty Furniture.
13. Return (Right of withdrawal)
13.1 The Customer, in the case of being a customer, can exercise the right of withdrawal without being required any compensation, within 14 (fourteen) days from the day on which the customer acquires physical possession of the property.
To exercise this right, the Customer may use a draft, indicating all his identification data, the product he intends to return and the date of cancellation. The communication must be made, by letter, through the return of the acquired asset, or by another appropriate and susceptible means of proof within the period defined above.
The customer must, within 14 (fourteen) days from the date of the communication of the return, return the goods to Jovaty Furniture in the proper conditions of use.
The packaging must be returned complete, as it was delivered and accompanied by all documentation received, namely, the following documents: sales invoice and the document that proves the receipt of the product. The packaging and the indicated documents must be sent free of charge to the following address:

If the Customer chooses other forms of return, the respective shipping costs will be his responsibility.
13.2. After receiving the return at Jovaty Furniture, the amount corresponding to the amount paid for the order (sales invoice value) will be returned to the Customer. If you have used a promotional discount code, this amount will not be refunded, that is, the refund will only be for the amount actually paid.
13.3. The method of refunding the amount to be returned depends on the payment method used in the respective order. In the case of payments by credit card and PayPal, these are credited to the respective accounts. In the remaining cases, when the account number information is provided, the refund is made to the indicated bank account.
Otherwise, the refund is made by check to the billing address. The reimbursement is made up to 14 days after the receipt of the free will resolution and the receipt of the return of the asset.
13.4. In the absence of any of the components of the item sold or, if any of them are not in excellent condition, there will be no refund of the price or postage, and the product will be sent back to the initial shipping address.
14.1. The Customer may submit any contractual conflicts, to arbitration and mediation mechanisms that are or may be legally constituted, as well as complain to Jovaty Furniture of acts and omissions that violate the legal provisions applicable to the acquisition of goods.
14.2. The complaint must be submitted within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the Customer, being registered in the information systems of Jovaty Furniture, which must decide the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of receipt.

The satisfaction of all orders placed on the website is subject to availability. Jovaty Furniture tries to ensure that all items offered for sale on the website are in stock. However, Jovaty Furniture reserves the right not to accept any orders or to cancel orders already confirmed for products that no longer have stock. In these cases, Jovaty Furniture will inform the customer of this fact via e-mail, in order to understand whether he wishes to change or cancel the order or to reserve the item while waiting for the stock to be replenished.
17. Validity of the promotion
The offers on the website are only valid for the time they are displayed on the website, unless otherwise stated on the website. Jovaty Furniture is not bound to any offer if there are errors or mistakes in spelling, prices or others in the information on the website. Jovaty Furniture reserves the right to cancel any purchase and sale entered into under such errors.
18.1 Jovaty Furniture will only be responsible for damages suffered by the customer in the event that such damages result from violations attributable to Jovaty Furniture's contractual obligations towards the customer, or in the event that Jovaty Furniture's liability results from the applicable legal law.
18.2 If the customer has suffered damage related to the activity of the website, Jovaty Furniture's liability will be limited to:
● Damage to Jovaty Furniture products or other materials;
● Reasonable and verifiable costs incurred by the customer to find the cause and amount of damages attributable to the damage;
● The maximum refund of the aforementioned compensation will be (if applicable) the price of the products concerned.
18.3 Jovaty Furniture cannot be held responsible for damages suffered by third parties resulting from the use of any of our products. Jovaty Furniture cannot be held responsible for damages suffered by the customer as a result of improper use of our products.
18.4 Jovaty Furniture is not responsible for damages that are the result of incorrect information on the website.
18.5 In the event that the customer suffers damages that are the result of serious negligence or fraud on the part of Jovaty Furniture, none of the limitations contained in this article apply.
19. Applicable law
The Contract is governed by Portuguese law.
20. Changing the Terms & Conditions
Jovaty Furniture has the right to change these Terms & Conditions at any time. The customer is subject to the principles and terms in force on the date of his order, unless the law or competent authority imposes any changes to them.
21. Information on the website
Although Jovaty Furniture works with care on its website, information, text, graphic documents, films, music and/or other services may contain errors or be incomplete or incorrect.
22. Intellectual Property

22.4 The Customer undertakes to fully respect the rights referred to in the preceding paragraph, namely refraining from practicing any acts that may violate the law or those rights, such as reproduction, commercialization, transmission or placement available to the public of such content or any other unauthorized acts which have as their object the same content.
23.1 Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the Customer that relate to the Service, including any changes to these General Conditions, may be made to the Customer's email address, by SMS or contact telephone.
23.2 The Customer agrees to receive any and all communication and/or notification related to the Online Store, to the address, phone number and/or email address indicated in the ordering process.
At any time, you can request not to receive these communications and/or notifications through the Contact Form or through the option of the option “Do not receive the Newsletter” registered in each Newsletter.
24. General e-gift conditions
E-gifts purchased or issued through our online store are for exclusive use at www.jovaty.com
After purchasing or issuing an e-gift, it cannot be converted into cash and cannot be refunded for any other type of payment.
If you have selected the e-gift refund method on your return, it will be sent to the email on your order, as soon as the conformity of your item is validated upon receipt at our warehouse.
This e-gift, generated in the context of a return, is not convertible into cash or the payment method used by the customer in the original order.
Refunds on orders paid with e-gift will always be returned by the same method, i.e. e-gift.
An e-gift can be used for purchases above or below your balance. If the value of your purchase is higher, you will be asked to pay the remaining amount. If the value of your purchase is lower, the code of your e-gift keeps the excess value in balance. Your e-gift can be used as long as it has a balance.
You can use more than one e-gift in the same order.
At any time, you can check the balance of your e-gifts by accessing your Customer Area, selecting the Profile tab and choosing the option “E-Gift Balance”.
The acquisition of e-gifts cannot be combined with campaigns, discounts or promotions.

Tax-free issuance is possible for a minimum order of 50 euros plus VAT, and the customer has 2 months to place the order. The billing address for the order is always the delivery address for the order (i.e. EU).

3. The 2 documents must be stamped and validated by customs;

26. Service Security Conditions
26.1 The Customer undertakes to observe all applicable legal provisions, namely, not to practice or encourage the practice of illegal or offensive acts of good customs, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the provisions of legislation applicable to the processing of personal data and advertising communications through automatic calling devices, and must also observe the rules for using the Service, under penalty of Jovaty Furniture suspending or deactivating the Service.
26.2 The Customer expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network that can be used by several customers, and as such, subject to computer overloads, so Jovaty Furniture does not guarantee the provision of the Service without interruption, loss of information or delays.
26.3 Jovaty Furniture also does not guarantee the provision of the Service in situations of unpredictable overload of the systems on which it is supported or of force majeure (situations of an extraordinary or unpredictable nature, outside of Jovaty Furniture and which cannot be controlled by it).
26.4 In the event of interruption in the provision of the Service due to unforeseeable overload of the systems on which it is supported, Jovaty Furniture undertakes to regularize its operation as soon as possible.
